84% of Spanish SMEs are still not adapted to the Anti-Fraud and Crea y Crece laws. This is revealed by the barometer on the adaptation of Spanish SMEs to both laws from Grupo Aitana, Opentix.

This study, carried out in June and July 2024, included the participation of 300 professionals from Spanish SMEs from various sectors, with up to 250 employees and local, national or international presence.

Limited knowledge of new regulations

The results show that respondents have a moderate knowledge of the new laws. The Anti-Fraud Law (Law 11/2021, of July 9), which establishes measures to prevent and combat tax fraud, is well known by 35% of those surveyed. On the other hand, the Business Creation and Growth Law (Law 18/2022, of September 28), which seeks to facilitate the creation of companies, reduce regulatory obstacles, combat late payments and promote business growth, is well known for only 29% of the participants.

Adaptation still in process: Anti-Fraud Laws and Create and Grow

In general, only 16% of the companies surveyed comply with all the requirements of both regulations. Among companies that have not yet fully adapted, 83% plan to do so in the next 12 months.

Regarding the Anti-Fraud Law, 56% of respondents who are aware of the regulations claim to comply with all mandatory requirements, while 33% comply with only some of them. 5% of respondents do not meet the requirements and do not have a defined plan to do so.

Regarding the Crea y Crece Law, 55% of professionals who know the regulations currently comply with all its mandatory requirements. 36% do not meet the requirements, but have a defined plan to achieve it, while 9% do not meet the requirements and do not have a plan to achieve it.

Finally, regarding the effort required to adapt to these regulations, 50% of companies perceive an average effort. 31% consider that the effort has been high, both in time and financial resources, and 19% believe that the impact on time and budget has been insignificant.
